Our role in protecting your data

At JS we take our responsibility of protecting our customers data seriously, and therefore we continue to stay compliant with and updated on GDPR legislation.

In consultation with the internationally renowned law firm Hogan Lovells (Frankfurt, Germany) we have ensured legal compliance and certainty. Based on their legal assessment, JS World Media Group qualifies as a data controller pursuant to Art. 4 No. 7 GDPR, not as a processor.

This assessment is formed on the basis that JS World Media Group makes all major decisions about the purpose and scope of processing of data, and that the customer does not influence the data processing.

The German supervisory authorities (e.g. Bayerisches Landesamt für Datenschutzaufsicht) confirm that service providers offering similar products (e.g. printed brochures, catalogs, or translations) are qualified as controllers rather than processors.

Our responsibilities as a data controller

A company which works with personal data is either a data processor or a data controller.

At JS we are data controllers. The main service of a data controller is to solve a specific task that does not involve processing personal data. At JS, we produce and publish professional communication packages for our customers for which we acquire advertising partners. Therefore the parties involved should not sign a DPA.

In our role, we live up to all legal requirements for data controllers.

On the other hand, a data processor’s main service is to process personal data on behalf of a customer. They receive data from the customer, refines, secures and return data to the customer. JS is not a data processor.

✅ JS makes the decisions

JS World Media make all decisions regarding the purpose and means of data processing. The client does not provide binding instructions regarding the processing of personal data.

✅ JS creates and distributes communication packages

The core service provided by JS World Media is the creation and distribution of communication packages, which are developed independently and financed by advertising partners. The processing of personal data (e.g. names or images of employees) is incidental to this activity.

✅ JS works under own editorial discretion

JS World Media operates under its own editorial and creative discretion, and the customer’s role is limited to providing input or approvals, without influencing the data processing framework.

✅ JS ensures no processing of personal data

In cases involving web development support, technical measures have been implemented to ensure that JS World Media does not process personal data on behalf of the client. Contracts with hosting or cookie providers are concluded directly between the client and those providers.
